How do I file a DMCA takedown?
A Brief Overview of the Digital Millennium Copyright Act (DMCA) Notice & Takedown Process
You or your authorized representative will usually file a DMCA takedown by submitting a formal written notice to the platform hosting the infringing content—for example, Reddit, Google, TikTok, or many others. It's usually done through a designated webform or email address listed in the website's footer or contact page.
In the US, media platforms are required to investigate and remove any infringing content quickly to avoid legal penalties. So they acts as an intermediary, sharing your report with the party responsible for the alleged violation.
Timeline
The bigger companies process cases constantly, so they're often very efficient about it. Some cases may drag on for weeks or months. The accused party may also file a counter-claim, disputing your claim that they infringed on your rights. Some cases are never resolved—for example, many web hosts exist outside of US jurisdiction, where disincentives are harder to enforce. Other cases are reported and resolved in under an hour. Most are in-between: a week or less is typical for large, established platforms.
Format
The DMCA notice is generally written from templates, because each letter must include a lot of boilerplate language stipulated in the DMCA.- Identification of the copyrighted work you believe has been infringed
- Identification of the material you believe is infringing and its location on the website
- Contact information so that the hosting provider can contact you, such as an address, phone number, and email address
- A statement that you have a good faith belief that use of the copyrighted material is not authorized by the copyright owner, its agent, or law
- A statement affirming under penalty of perjury that all the information in your notice is accurate
- A physical or electronic signature. This can be your signature or that of your authorized agent
If you leave anything out, your claim can be rejected. If you are dishonest or intentionally misuse the DMCA, you can face major consequences.
